By accessing or using the Site or purchasing our services, you agree to be bound by these Terms.
These Terms form a legally binding agreement between you and Just Say Hey.
1) Acceptance of Terms
By registering for or using our Services in any way, you confirm that you have read and understood these Terms of Service and agree to comply with them. If you do not agree with these Terms, you must not use the Services.
2) Eligibility
You must be at least 16 years old to create a Just Say Hey account.
If you are aged 13 to 15, a parent or guardian must create and manage the account on your behalf. You may access the course using their account, provided they agree to supervise your participation and remain responsible for your use of the Services.
By using the Services, you confirm that either:
(a) you are at least 16 years of age, or
(b) you are under 16 and have permission to use the Services via a parent or guardian's account.
We reserve the right to suspend or remove any account that appears to be used by someone under 16 without appropriate consent or supervision.
3) Registration
To access our Services, you must create an account. You agree to provide accurate and complete information and keep your login credentials secure. You are responsible for all activity associated with your account.
If you are a parent or guardian creating an account for someone under 16, you agree to supervise their use of the Services and accept responsibility for their participation.
4) Privacy and Data Use
We are committed to protecting your privacy. Our data collection and use practices are explained in our Privacy Policy, which is incorporated into these Terms by reference.
By using our Services, you acknowledge and consent to the collection and handling of your personal information as described in our Privacy Policy.
We do not knowingly collect personal information directly from individuals under 16. If you are under 16, please do not provide any personal data directly. Your parent or guardian must do so on your behalf.
5) Content and Intellectual Property
All content on the Site, including videos, text, graphics, downloads, and course materials, is owned by or licensed to Just Say Hey. You may use our content for personal, non-commercial use only. You may not copy, distribute, modify or sell any part of our content without written permission.
We reserve the right to update, remove or restrict access to any content at our discretion.
6) Payments and Billing
Some Services are paid. Fees must be paid in full at the time of purchase. Prices are displayed in Australian dollars and include GST where applicable.
We use a secure third-party payment processor. By providing payment details, you authorise us to charge your selected payment method for the amount agreed.
For subscription products, your payment will auto-renew unless cancelled before the next billing period.
7) Refunds and Disputes
We stand by the quality of our programs. If you're unhappy with your purchase, contact us at hello@justsayhey.net within 14 days.
Refunds will be provided where required under the Australian Consumer Law. Refunds for change of mind or non-completion are not guaranteed.
If a concern arises, we encourage you to contact us directly first. If we cannot resolve the matter informally, you may refer your complaint to Consumer Protection WA or another dispute resolution body. All disputes will be governed by the laws of Western Australia.
8) Warranty Disclaimer
Our Services are provided “as is” and “as available”. We make no warranties about the accuracy, completeness, or suitability of our content for your individual needs. Your use of the Services is at your own risk.
We do not guarantee uninterrupted access to the Site or Services, and we are not liable for any technical issues, loss of data, or interruptions.
9) Limitation of Liability
To the fullest extent permitted by law, Just Say Hey is not liable for any indirect, incidental, or consequential damages, or for loss of data, income, or business. Our total liability is limited to the amount paid by you for the Services during the three months prior to any claim, or $500 AUD, whichever is greater.
10) Indemnity
You agree to indemnify and hold harmless Just Say Hey and its directors, staff, and contractors from any claims, losses, or damages arising out of your use of the Services, breach of these Terms, or violation of any law or third-party rights.
11) Changes to Terms
We may update these Terms from time to time. Any updates will be posted on our Site. By continuing to use the Services after changes are posted, you accept the updated Terms.
12) Governing Law
These Terms are governed by the laws of Western Australia. Any legal action must be brought in the courts of Western Australia.
